How to Register a Trade Mark

By Candace Westby, TM Examiner

In August, all of the Cayman Islands’ modernised intellectual property laws came into effect!

Did you know part of that regime allows you do to register a trade mark right here in Cayman?

Do you know HOW to get your trade mark registered in the Cay-man Islands?

First, do a self-assessment and ask yourself a few questions: Is your trade mark unique? Is it highly fanciful; a made-up word; or an image that allows your products or services to be immediately identified?

Second, remember that Cayman Islands symbols, flags and other protected emblems are prohibited for use in your trade mark, unless you have the express permission of our government.

And please note – this prohibition doesn’t just apply in Cayman – it applies to symbols, flags and other protected emblems of all countries and international organisations. Once you’ve done this quick self-assessment, then you can follow the steps in the graphic. When you get to the step of hiring a local registered Intellectual Property Agent (IPA), you can check out our web-site, www.ciipo.gov.ky.

For your convenience, we’ve published the full list of IPAs in Cayman.

As always, CIIPO is here to help you, so I do encourage you to look at our website.

In addition to the IPA list, it has lots of useful information on ALL of our modernised IP laws: copyright, patents, design rights, and trade marks.

Your creativity, legally backed by Cayman’s new IP laws, means that good things can happen!

Let’s get creating Cayman!
